Terms of Service

Welcome to Rovix Cloud ("we", "our", or "us"). These Terms of Service govern your use of our web hosting, domain registration, cloud infrastructure, and related services. By using our services, you agree to these terms.
1. Services Provided
Rovix Cloud provides:
- Shared, VPS, and dedicated hosting
- Cloud infrastructure and storage
- Domain registration and SSL certificates
- Email and DNS hosting
- Technical support and server management
Service Availability: We strive to maintain 99.9% uptime for all our services, subject to scheduled maintenance and unforeseen circumstances.
2. Account Responsibilities
Account Requirements:
- You are responsible for keeping your login credentials confidential
- You must provide accurate contact and billing information
- You must provide a valid, regularly monitored email address as our primary communication method
- You must notify us immediately of any unauthorized access to your account
- You are responsible for all activities that occur under your account
Security Notice: Use strong passwords and enable two-factor authentication where available. You are liable for any damages resulting from failure to secure your account.
3. Acceptable Use Policy
By using our services, you agree NOT to:
Prohibited Content & Activities:
- Host or transmit illegal, abusive, or harmful content
- Use services for spam, malware, or phishing attacks
- Violate the intellectual property of others
- Undermine server/network integrity
- Perform or facilitate port scanning from your hosting or cloud instance
- Run cryptocurrency mining software or services
- Initiate or participate in DDoS attacks or botnet networks
- Host open proxies, open SMTP relays, or open VPN services without authorization
- Distribute adult content without proper age verification
- Engage in activities that violate applicable laws or regulations
Violation Consequences: Violation of these policies may result in immediate suspension or termination without refund. We reserve the right to report illegal activities to relevant authorities.
4. Payment Terms
Billing & Payment:
- All services must be prepaid unless specified otherwise
- Late or failed payments may result in account suspension
- We reserve the right to change pricing with 15 days' prior notice
- Payments are processed in NPR unless otherwise specified
- All prices are exclussive of applicable taxes and VAT
- Refunds are subject to our refund policy
Auto-Renewal:
- Services automatically renew unless cancelled
- You can disable auto-renewal in your client portal
- Renewal notices are sent 7 days before renewal date
5. Suspension and Termination
We may suspend or terminate your services if:
- You breach these terms
- There are legal or regulatory demands
- Payment is overdue for more than 7 days
- Your account poses a security risk to our infrastructure
- Excessive resource usage affects other customers
- You fail to respond to support requests regarding violations
Termination Process:
- We will attempt to notify you before suspension when possible
- Immediate termination may occur for severe violations
- You have 30 days to retrieve your data after termination
- No refunds for terminated accounts due to policy violations
6. Backups and Data Loss
We offer routine backups for select plans, but do not guarantee full recovery. You are responsible for backing up your own data.
Data Responsibility:
- Regular backups are your responsibility
- We provide backup services as a convenience, not a guarantee
- We are not liable for data loss regardless of cause
- Backup restoration may incur additional charges
- Data retention policies vary by service type
Important: Always maintain independent backups of your critical data. Our backup services are supplementary and not a replacement for your own backup strategy.
7. Limitation of Liability
We are NOT liable for:
- Data loss
- Downtime
- Indirect or consequential damages
- Loss of profits or revenue
- Third-party service failures
- Security breaches beyond our control
- Force majeure events
Liability Cap: Our total liability is limited to the amount paid by you in the last 3 months. This limitation applies regardless of the cause of action.
8. Intellectual Property
Your Content:
- You retain ownership of content you upload to our services
- You grant us license to host and deliver your content
- You are responsible for ensuring you have rights to uploaded content
- We may remove content that violates intellectual property rights
Our Property:
- Our software, infrastructure, and documentation are proprietary
- You may not reverse engineer or copy our systems
- Our trademarks and logos may not be used without permission
9. Service Level Agreement (SLA)
We provide the following service level commitments:
- Uptime Guarantee: 99.9% uptime for shared and VPS hosting
- Response Time: Support tickets answered within 24 hours
- Network Performance: Monitored 24/7 for optimal performance
- Security Updates: Regular security patches and updates
SLA Credits: If we fail to meet our uptime guarantee, you may be eligible for service credits. Contact support within 30 days to claim.
10. Governing Law
These Terms are governed by the laws of Nepal. All disputes will be resolved in the District Court of Kathmandu.
Dispute Resolution:
- We encourage resolving disputes through direct communication
- Mediation may be attempted before legal proceedings
- You agree to jurisdiction of Nepalese courts
- Any legal proceedings must be in English or Nepali language
11. GDPR Compliance (for EU Users)
If you are located in the European Union, Rovix Cloud complies with the General Data Protection Regulation (GDPR):
- You have the right to access, correct, delete, or transfer your personal data
- You may withdraw consent at any time
- EU users may contact our Data Protection Officer (DPO) at privacy@rovixcloud.com
- Data processing is based on legitimate business interests and consent
- We implement appropriate technical and organizational measures

12. Communication Methods
Email is our primary communication medium for all official correspondence, notifications, and support communications.
Official Communications:
- All service notifications and alerts will be sent via email
- Billing invoices and payment reminders are delivered by email
- Support responses and technical communications via email
- Account security notifications sent to your registered email
- Policy updates and important announcements via email
- Legal notices and terms changes communicated through email
Your Email Responsibilities:
- Maintain an active and accessible email address
- Check your email regularly for important communications
- Update your email address immediately if it changes
- Ensure our emails are not blocked by spam filters
- Respond promptly to urgent security or billing notifications
Important: You are responsible for monitoring your email for all communications from Rovix Cloud. Failure to receive or respond to email communications may result in service interruptions.
Email Domains: Official communications will come from @rovixcloud.com addresses. Always verify the sender before responding to requests for sensitive information.
13. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website.
- Significant changes will be communicated via email
- Continued use constitutes acceptance of new terms
- You may terminate services if you disagree with changes
- Previous versions are archived and available upon request
